HARVEY CEDARS, NJ                                                       March 3, 2006

 

The regular meeting of the Board of Commissioners of the Borough of Harvey Cedars, NJ was called to order by Mayor Oldham at 4:34pm who stated to the best of his knowledge all requirements of the State Sunshine Law had been met.  Commissioner Gerkens was present.  Commissioner Garofalo and Board Attorney John Cerefice were absent.

 

The Mayor asked all to rise for the Pledge of Allegiance.

 

Motion to approve the minutes of the previous meeting, February 21, 2006, was made by

Commissioner Gerkens.

 

Motion to approve the minutes of the special meeting, March 3, 2006 at 9:00am, was made by Commissioner Gerkens.

 

The Mayor read the following ordinance by title and number and asked for a motion to introduce. 

 

ORDINANCE #2006-06 FIRST READING

CAPITAL IMPROVEMENT ORDINANCE OF THE BOROUGH OF HARVEY CEDARS, OCEAN COUNTY, STATE OF NEW JERSEY PROVIDING FOR THE ACQUISITION OF PLAYGROUND EQUIPMENT AND SAFETY SURFACING NOT TO EXCEED $75,000.00

A copy of the full ordinance as introduced is attached hereto and made a part hereof.

Motion to adopt: Commissioner Gerkens

   Second: Mayor Oldham

   Vote: Ayes – Oldham, Gerkens

 

The Mayor read the following resolution by title only and asked for a motion to adopt.

RESOLUTION #2006-031: Bills

A copy of the resolution is attached hereto and made a part hereof.

Motion to approve the bills for payment was made by Commissioner Gerkens.

 

A motion was made by Commissioner Gerkens to approve the request to use Hudson Ave. beach to Joe Keenan and the NSSA for 2 surfing contests from 7am to 4pm on the following dates:

                        Sunday, May 7, 2006 – “no surf date” May 21st

                        Sunday, October 1, 2006 – “no surf date” October 8th

 

A motion was made by Commissioner Gerkens to approve the request to use Sunset Park, the beach and bay to Alexander Engel for the taping of a NYU student film on April 6, 2006 to April 16, 2006 from 7am to 7pm.

 

PRIVILEGE OF THE FLOOR:

Members of the public present:  Al Wright, 3 Cedars Ave., Barbara Lehman, 6303 Long Beach Blvd., Mr. and Mrs. Greber, 5 E. 80th Street, Mr. and Mrs. Jack Shultis, 8 E. Bergen Ave., Tom Christopoul, 5419D Long Beach Blvd., Joe Krug, 44 W. 80th Street, Phil Kunz, 17A W. 76th Street, John Gerkens, 7 W. Burlington Ave., and the press.

 

Mayor Oldham announced that there will be a meeting March 10th with the DEP specifically for the property owners who have not signed the deed of easement.  He invited the public to come up with ideas on how to secure the deeds.

 

Bettie Greber, asked the following questions for the Taxpayers Association:

  1. How are you dealing with the folks that are worried about the dune obstructing their view?  Mayor Oldham responded that the Borough Engineer is submitting either a petition or a waiver to the Army Corps of Engineers to modify the dune height by reducing the height and making it wider.  This waiver should have been submitted today.
  2. Is there any flexibility with regards to the easement document?  Commissioner Gerkens said no.
  3. What do you plan to do about the easements that are not signed by the next meeting, March 21st?  Is there a timetable?  Mayor Oldham believes that Harvey Cedars can not afford to go to eminent domain on multiple properties.  The State will not do the project unless all the easements are obtained.  He feels that residents should start calling the people they know (unsigned deed homeowners) to encourage them to sign.  The project is scheduled to start in the fall in Surf City and Ship Bottom, if their easements have been obtained.  It is possible that if Surf City and Ship Bottom do not get their deeds signed, and Harvey Cedars does, then the project may start here, even though Harvey Cedars is considered a feeder beach (sand travels to Long Beach Township).

 

A discussion continued with the public regarding the project.  Tom Christopoul will send letters to the unsigned list following the outcome of the March 10 meeting.  Mayor Oldham will get a final decision in writing on the bathroom requirement in Harvey Cedars.  Meetings with the DEP would be difficult to set up on a Saturday, but the Borough Engineer is willing to meet with people on a Saturday.  Studies were performed on the 86th Street jetty 2 summers ago by the Stevens Institute.
