The regular meeting of the Board of Commissioners of the Borough of Harvey Cedars, NJ was called to order by Mayor Oldham at 4:33pm who stated to the best of his knowledge all requirements of the State Sunshine Law had been met.  Commissioner Garofalo was present.  Commissioner Gerkens and Board Attorney John Cerefice were absent.

 

The Mayor asked all to rise for the Pledge of Allegiance.

 

Motion to approve the minutes of the previous meeting, March 3, 2006, was made by

Commissioner Garofalo.

 

The Mayor read the following resolution by title only and asked for a motion to adopt.

RESOLUTION #2006-032:  TEMPORARY CAPITAL BUDGET

 

          WHEREAS the Borough of Harvey Cedars desires to constitute the 2006 Temporary Capital Budget of said municipality by inserting therein the playground equipment project.

 

            NOW, THEREFORE, BE IT RESOLVED by the Commissioners of the Borough of Harvey Cedars as follows:

 

Section 1.         The 2006 Temporary Capital Budget of the Borough of Harvey Cedars is hereby constituted by the adoption of a schedule to read as follows:

RESOLUTION #2006-033:  TEMPORARY BUDGET AMENDMENT

 

WHEREAS N.J.S. 40A:4-19.1 provides that in any fiscal year for which the budget dates have been extended, the Director of the Division of Local Government Services may permit temporary budget appropriations to provide for the period between the date upon which the budget was scheduled for adoption pursuant to N.J.S.A. 40A:4-5 and the actual date upon which the budget is adopted; and

 

                WHEREAS the date of this resolution is after the scheduled adoption date of February 21, 2006.

The Mayor read the following resolution by title only and asked for a motion to adopt.

RESOLUTION #2006-034:  RESCINDING REQUEST FOR A DEDICATED TRUST BY RIDER FOR UNIFORM CODE ENFORCEMENT FEES

 

WHEREAS the Board of Commissioners of the Borough of Harvey Cedars adopted Resolution #2006-026 on February 21, 2006 requesting approval from the Director of the Division of Local Government Services to establish a dedicated trust by rider for uniform code enforcement fees; and

 

WHEREAS it has been determined by the Borough’s auditor and chief financial officer that said approval is not necessary and was erroneously requested.

 

            NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Harvey Cedars that Resolution #2006-026 is hereby rescinded and a certified copy of this resolution be forwarded to the Director of Local Government Services.

RESOLUTION #2006-035:  TRANSFER OF FUNDS

 

            WHEREAS the date of this resolution is within the last two months of the calendar year 2005, and the first three months of the calendar year 2006; and

 

            WHEREAS N.J.S.A. 40A:4-58 provides for the making of transfers between budget appropriations during the five month period beginning November.

RESOLUTION #2006-037:  APPOINTMENT OF LOCAL EMERGENCY PLANNING COMMITTEE

 

WHEREAS the Borough of Harvey Cedars Office of Emergency Management is required by the State of New Jersey to appoint a Local Emergency Planning Committee (LEPC); and

 

WHEREAS the Board of Commissioners desires the following individuals to serve as members of the LEPC:

A motion was made by Commissioner Garofalo to approve the request to use Sunset Park to Katie Kochera & Jay Nistad for a wedding ceremony on Saturday, September 15, 2007 from 4pm to 9pm.

 

PRIVILEGE OF THE FLOOR –

 

Kevin O’Such of North Beach described his Eagle Scout project to the Board.  Kevin requested approval from the Board to pass an ordinance for no smoking in the playground area of Sunset Park.  Kevin will also seek approval from the LBI Board of Education to conduct a contest of its 5th graders to design a sign to be placed at the playground.  Kevin gave the Board a copy of Surf City’s no smoking ordinance as an example.  The Mayor asked members of the public if there were any objections or opinions on this ordinance and there were no objections.  The Mayor agreed to the project and signed Kevin’s approval form.  An ordinance will be introduced at the next meeting.

 

Brian Lewis, 10 E. 83rd Street, asked the following questions for the Taxpayers Association:

1.      If our beach is replenished in the fall, when do we need to be in receipt of the signed easements?  The Mayor said the sooner the better, but there is no official date.  If the project starts in the fall, it would be best to have them before the summer.

2.      There has been talk about 20 foot dunes instead of 22 foot dunes.  When will that be approved?  The formal application has been submitted to the Army Corps for review that will be done by a lost/cost ratio – if the ratio is not within the guidelines, it would go to OMB for approval (where it probably will not be approved).

3.      Do you have a list of oceanfront easement signers that have a problem with the dune height?  The Board said the Borough is working on the category list.

4.      There is a list of “missing 10” (property owners with no contact).  Have they been found?  Commissioner Garofalo said all but 2 people have been contacted.  Mr. Lewis suggested the internet search engine “zabasearch”.

5.      Can the oceanfront easement signers have someone represent them in the drafting of the new easement agreement?  Commissioner Garofalo said that is up to the DEP, but he felt that if Harvey Cedars was allowed to participate, the other towns would also want to get involved.  Mayor Oldham was pleasantly surprised that at the meeting (March 10th) the DEP considering an addendum.  He said that was a big step.

6.      There has been some confusion on voting if you don’t live in town.  How can one vote?  Commissioner Garofalo said that you just need to register in Harvey Cedars (Ocean County).  He said there are a lot of people that “split” votes (one registered here, and the other at their other property).

 

Joe Krug mentioned that 40 years ago a Harvey Cedars election was challenged because a lot of people who did not reside here year-round changed their voter registration to Harvey Cedars and voted.  A court determined the primary residency is where the voter filed their federal income tax.  If it was not filed from Harvey Cedars, the votes were thrown out.

 

John Weber from the Surfriders Association spoke regarding opposition to the proposed beach replenishment project.  He submitted reports and letters regarding previous projects done by the Army Corps.  He wanted to make sure the governing bodies and locals are aware that they do have a say in the construction of the project. The following also voiced their concerns about the project:  Jonathan Coen, surfing columnist, Bill Mahatka, licensed engineer from Manahawkin, Dave Horner, surfer/teacher from Manahawkin, Pat Emery, Beach Haven, Mike Panone, North Beach, and Kate Sweeney, 36 West 80th Street.

 

The Board said they would set up a meeting with the Surfriders Association after review of the presented documents.
