HARVEY CEDARS, NJ April 7, 2006
The regular meeting of the Board of Commissioners of the Borough of Harvey Cedars, NJ was called to order by Mayor Oldham at 4:31pm who stated to the best of his knowledge all requirements of the State Sunshine Law had been met. Commissioners Gerkens and Garofalo were present. Board Attorney John Cerefice was absent.
The Mayor asked all to rise for the Pledge of Allegiance.
Motion to approve the minutes of the previous meeting, March 21, 2006, was made by
Commissioner Gerkens, seconded by Commissioner Garofalo.
The Mayor read the following ordinance by title and number and asked for a motion to introduce.
AN ORDINANCE AMENDING CHAPTER 3 OF THE REVISED GENERAL ORDINANCES OF THE BOROUGH OF HARVEY CEDARS, 1975, ENTITLED “POLICE REGULATIONS”
(Smoking prohibited in playground areas)

The Mayor read the following resolution in full and asked for a motion to adopt.
RESOLUTION #2006-038: BUDGET ADOPTION
WHEREAS in accordance with the Local Budget Law, public hearing was held for the 2006 budget on February 21, 2006; and
WHEREAS the budget adoption was deferred until State Aid allocations were provided; and
WHEREAS the State has provided said allocations and no public comments or objections were made at the public hearing.
NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Harvey Cedars, County of Ocean that the budget hereinbefore set forth is hereby adopted and shall constitute an appropriation for the purposes stated of the sums therein set forth as appropriations, and authorization of the amount of $2,424,672.60 for municipal purposes.

Motion to approve the bills for payment was made by Commissioner Garofalo, seconded by Commissioner Gerkens
A motion to approve request to use Sunset Park parking facilities to the LBI Foundation of Arts for their house tour on Wednesday, August 2, 2006 from 9am to 5pm was made by Commissioner Garofalo, seconded by Commissioner Gerkens.
A motion to approve request to use Hudson Ave. beach to Freedom Surf Shop for their Annual Youth Surfing Contest on Saturday, June 17, 2006 was made by Commissioner Garofalo, seconded by Commissioner Gerkens.
PRIVILEGE OF THE FLOOR –
Ilan Plawker, 15 East Lee Ave., offered his help with obtaining the easements. A discussion pursued with the Board regarding the beach project and Mr. Plawker volunteered to write a letter to the oceanfront homeowners who have not yet signed.
