HARVEY CEDARS, NJ                                                       July 7, 2006

 

The regular meeting of the Board of Commissioners of the Borough of Harvey Cedars, NJ was called to order by Mayor Oldham at 4:30pm who stated to the best of his knowledge all requirements of the State Sunshine Law had been met.  Commissioners Gerkens and Garofalo and Board Attorney John Cerefice were present.

 

The Mayor asked all to rise for the Pledge of Allegiance.

 

Motion to approve the minutes of the previous meeting, June 20, 2006, was made by

Commissioner Garofalo, seconded by Commissioner Gerkens.

 

Motion to approve the minutes of the special meeting held on June 30, 2006, was made by

Commissioner Gerkens, seconded by Commissioner Garofalo.

 

The Mayor read the following resolution by title only and asked for a motion to adopt.

RESOLUTION #2006-062: 

CHAPTER 159 ITEM OF REVENUE INSERTION IN THE SUM OF $2,000.00 –

COPS IN SHOPS

RESOLUTION #2006-063: 

AUTHORIZING REFUND OF TENNIS COURT FEES

The Mayor read the following resolution and asked for a motion to adopt.

RESOLUTION #2006-065: 

BE IT RESOLVED by the Board of Commissioners of the Borough of Harvey Cedars that the Municipal Clerk, in conjunction with the Borough Engineer, is hereby authorized to solicit bids for the following projects:

1.      water tower painting

2.      repairs to public works garage

3.      2006 road project

RESOLUTION #2006-066: Bills

A copy of the resolution is attached hereto and made a part hereof.

Motion to approve the bills for payment was made by Commissioner Garofalo, seconded by Commissioner Gerkens.

 

A motion was made by Commissioner Gerkens, seconded by Commissioner Garofalo, to approve the request to use Sunset Park to Grace Calvary Church of Ship Bottom for a church picnic on September 17, 2006 from 10am to 9pm with the following conditions:

·        must meet with the Borough for placement of tents

·        made aware of the trash carry in/carry out policy

·        certificate of insurance necessary

 

REPORTS FROM COMMISSIONERS:

Mayor Oldham –

·        The State has been shutdown (with the budget impasse); not much has been heard about the beaches.  We are still talking to homeowners (regarding deeds).

 

PRIVILEGE OF THE FLOOR –

 

Wendy Chambers, 13 East 75th Street, had the following questions:

1.      Did the Borough get in touch with the property owners of non-buildable lots?  The Mayor said that everybody received a list of things to do and is working on it.

2.      Can the recycling can on Dorothy Sloma’s street (East Essex) be moved back to the beach?  Commissioner Gerkens said Public Works will take care of it.

3.      Can the Brod’s request be done?  The Board just received the Brod’s request and will contact them.

4.      Can the Borough send a note to the unsigned owners explaining the amount their taxes would be increased if we did not get the project?  Mayor Oldham said the Board has tried to communicate the amount of tax increase and that the Stockton meeting communicated that well.  He believes that it does not matter to some.

5.      An article from the New York Times was written about adverse possessions.  Can the Borough do this with the oceanfront properties?  Attorney John Cerefice said that would not apply in this situation.

6.      Are the speed limits going to change?  Commissioner Gerkens said the State DOT makes the determination, not the towns.  Harvey Cedars’ summer speed limits will remain the same at 30mph in the center of town and 35mph for the rest of the Boulevard.  North Beach, Loveladies and Barnegat Light will be 40mph.

7.      Can the Borough have crosswalks?  Police Chief Jerry Falkowski said that the Boulevard is a 4-lane highway with no center island, unlike Loveladies and North Beach, and there will always be at least 1 blind lane.  It would be dangerous for pedestrians.  For example, 3 lanes of traffic stop while a person is crossing and an oncoming vehicle in the 4th lane does not see why the traffic has stopped and continues through. This has been an issue and problem for years.  Unless there was a major restructuring of the road, crosswalks are not for Harvey Cedars.

8.      Anything we can do to make it easier to cross from the bay to the ocean?  Commissioner Gerkens asked if the Chief could have the timing of the Camden Ave. and Salem Ave. traffic lights checked for synchronicity.  The Chief said he would assign it to the traffic Sergeant.

9.      Can the Taxpayer’s Association have an inaugural meeting at the firehouse?  The Mayor said to contact the firehouse.  They are a separate entity.

10.  Is it possible to have a board meeting (Taxpayer’s Association) at the Borough Hall?  Commissioner Gerkens and Mayor Oldham said the logistics of when and how the Borough would be available would have to be worked out, but yes they could meet in this room (courtroom).  The Mayor suggested during working hours to avoid any overtime pay.

11.  In reference to the email about appliances and air conditioner pick up, can the town charge for appliance pick up?  Commissioner Gerkens said her impression from that email was that it said the Borough does charge a fee.  The Borough does not.  Bulk pick up is done 10 months out of the year.  For 2 months, July and August, Waste Management (the Borough’s contractor) does not take bulk items.  Items with Freon will not be picked up at anytime of the year.  State law requires Freon to be removed before disposal.  The Borough does not pick it up because Harvey Cedars doesn’t have enough appliances to hire someone to handle that.  The towns that pick up actually make money on it, but for Harvey Cedars it’s not worth it.  The Mayor mentioned that most places take the old appliance when a new one is bought.  Mr. Cerefice said that once the Freon is removed, it can be picked up (at the curb from September through June).

12.  Mr. Ellenbogen emailed about parking problems and designating driveway areas.  Can the town notify residents about designating the 18 foot driveway?  The Mayor said mailings have been done and the Borough would be happy to designate the 18 foot driveway with yellow paint.

13.  How many boats/trailers can be parked per property?  The Borough does not have an ordinance for that.

 

Commissioner Gerkens clarified a couple of items miscommunicated by Ms. Chambers in her email notifications:

1.      At the last meeting, the Board agreed to put a notice in the annual Highlights regarding cigarette butts, not to do a special mailing.

2.      The Board did not agree to have Board meetings at 7:30pm, but would discuss the possibility, and would notify the residents of the change if it did occur.

 

Mayor Oldham stated that the Emergency Management meeting on hurricane evacuation (held at the firehouse on June 28th) went very well and was professionally done.  Despite the flooding emergencies in Trenton, it was represented well by emergency personnel. The new Beach Haven mayor, Ship Bottom’s mayor and Long Beach Township’s mayor were also in attendance.
