HARVEY CEDARS, NJ                                                       November 3, 2006

 

The regular meeting of the Board of Commissioners of the Borough of Harvey Cedars, NJ was called to order by Mayor Oldham at 4:38pm who stated to the best of his knowledge all requirements of the State Sunshine Law had been met.  Commissioners Gerkens and Garofalo and Board Attorney John Cerefice were present.

 

The Mayor asked all to rise for the Pledge of Allegiance.

 

Motion to approve the minutes of the previous meeting, October 16, 2006, was made by

Commissioner Gerkens, seconded by Commissioner Garofalo.

 

The Mayor read the following ordinance by title and number and stated that proof of publication is on hand and the ordinance has been posted.

ORDINANCE #2006-18 SECOND READING

AN ORDINANCE OF THE BOROUGH OF HARVEY CEDARS AMENDING AND SUPPLEMENTING CHAPTER 7 OF THE REVISED GENERAL ORDINANCES OF THE BOROUGH OF HARVEY CEDARS, 1975, ENTITLED “SEWER AND WATER” TO ESTABLISH METER CONNECTION FEES

Commissioner Gerkens explained this ordinance was a result of the State mandating water meters to installed for new construction and major renovations.  Tom Christopoul, 5419D Long Beach Blvd., confirmed that this was not the Borough’s idea.  Commissioner Gerkens stated that none of the Island towns stay within the Water Allocation Permit during the months of July, August and September.

AN ORDINANCE OF THE BOROUGH OF HARVEY CEDARS AMENDING AND SUPPLEMENTING CHAPTER 3 OF THE REVISED GENERAL ORDINANCES OF THE BOROUGH OF HARVEY CEDARS, 1975, ESTABLISHING A NEW SECTION 3-6 ENTITLED “OVERSIZED VEHICLES”

Mayor Oldham explained this ordinance requires permission from the Police Chief to move an oversized vehicle on municipal roads.  Mr. Christopoul asked if this included a delivery truck for appliances.  The Mayor replied that this is only for situations such as modular homes, where the move can be a safety hazard.

Motion to approve the bills for payment was made by Commissioner Gerkens, seconded by Commissioner Garofalo.

 

PRIVILEGE OF THE FLOOR –

 

Wendy Chambers, 13 East 75th Street, asked why the voting machines were being photographed this week.  The Board said the Police Officers were photographed, not the machines.

 

Ms. Chambers asked if the Commissioners receive beach profile information (from the Army Corps).  The Mayor replied they could ask for it.  Ms. Chambers said the beach entrance at 77th Street is better, (harder) than at her street entrance.  The Mayor said it could be because sand mixed with gravel had been placed at the entrance for a storm and has packed down.  Commissioner Gerkens said she will look at the entrances.

 

A discussion followed with the Board and Ms. Chambers regarding the beach replenishment project and unsigned Harvey Cedars’ easements.  The Board is still waiting to see the outcome in Surf City regarding the lawsuit and the beginning of the project.

 

Commissioner Garofalo stated that the governing body is working on the municipal budget and invited members of the Taxpayer’s Association to sit in on the process.  The next budget meeting is tentatively scheduled for November 28th.  Mr. Christopoul appreciated the offer and is interested in getting a better understanding of the budget.  He asked what the fiscal year is and what the adoption process is.  Sharon Sulecki, CFO, responded that Harvey Cedars is a calendar year budget and the budget must be introduced by February 10th per State statute.

 

Mayor Oldham stated (regarding the beach replenishment project) that the State will be posting their policy on bathrooms and public access on November 6th and there will be an open comment period.  He stated that, in his opinion, he does not know why the State would have stronger requirements than Federal policy when the Federal government is providing the most funds.  The open comment period is 30 days and contacts will be provided.  He was not sure if feedback will be available online.  This is not a legislative issue; by law whenever the DEP adopts regulations, they are required to post them and have public comment.

 

Mr. Christopoul commented about the State condemning Surf City properties.  John Cerefice said the Attorney General, who acts on behalf of all State agencies, filed suit against the properties, but it is not a condemnation.  This lawsuit seeks public access without compensation.  If condemnations were filed, the State would own the easements and a trial would determine compensation.
