HARVEY CEDARS, NJ December 18, 2007
The regular meeting of the Board of Commissioners of the Borough of Harvey Cedars, NJ was called to order by Mayor Oldham at 4:30pm who stated to the best of his knowledge all requirements of the State Sunshine Law had been met. Commissioners Gerkens and Garofalo and Board Attorney John Cerefice were present.
The Mayor asked all to rise for the Pledge of Allegiance.
Motion to approve the minutes of the previous meeting, December 7, 2007 was made by
Commissioner Gerkens, seconded by Commissioner Garofalo.
The Mayor stated that per the Local Public Contracts Law, Beach Tech LLC requested a hearing with the Governing Body to discuss the rejection of their surf rake bid. A motion to open the hearing was made by Commissioner Garofalo, seconded by Commissioner Gerkens.
Mr. Nick Nicolay of Beach Tech LLC reviewed the points of non-compliance of specifications listed in the Borough Attorney’s letter (attached). He explained that even with the longer length of his machine, it would still be able to turn on the beaches and could be stored in the borough garage. He said his machine could not clean grassy areas, but the Borough’s old surf rake unit is capable of that service. He said the conveyor belt is not made of rubber (as written in the specs), the machine is of a different technology with a lift and sift steel belt. He said there are disadvantages to rubber belts. He said the ball bearings are really not an issue; both technologies are appropriate.
Commissioner Garofalo stated that the Borough is not planning on keeping two units, and would rather store and maintain one unit that does all the required cleaning necessary for the Borough, including grassy areas and the bay beach. Commissioner Gerkens added that the storage of two units is not feasible and that the Beach Tech unit is too large to clean the bay beach.
A motion was made by Commissioner Gerkens, seconded by Mayor Oldham, to reject the Beach Tech surf rake bid.
