HARVEY CEDARS, NJ                   SPECIAL MEETING                        July 19, 2008

 

The special meeting of the Board of Commissioners of the Borough of Harvey Cedars, NJ was called to order by Mayor Oldham at 11:00am.  Commissioners Garofalo and Gerkens were present.

 

This Special Meeting was called pursuant to the provisions of the Open Public Meetings Law. It was requested by the residents affected by Ordinance 2008-10.  Notice of this meeting was published in the Beach Haven Times.  In addition, copies of notices were posted on the bulletin board in the Municipal Building and the Post Office and mailed to affected residents.

The Mayor said that the purpose of this meeting was to discuss issues that could be worked on for the signing of the easement deed.  Mayor Oldham and the Commissioners relocated from the Dias to the public area for an informal meeting.  Residents who have not signed the deed of easement that were present were Victor and Carolyn Groisser, Martin Flumenbaum, Walter Strine and Paul Boehringer.  Also present were Mike Logan, President of the LBI Taxpayers’ Association, Brian and Susan Lewis, Stan Feeley, Shelly Horowitz, Doug Simpson, Mr. and Mrs. Jedziniak of Ship Bottom, Suzanne Keller, Ken Porro, Esq., and members of the press.

 

Mike Logan submitted dune profile plans from 2003 and from 2006 pointing out the project was modified. The Mayor said that the project design (dune height and width) has not been changed nor it can be, but the project location may be adjusted.  He added that a re-design of the project would require federal re-authorization.

 

Certain points were discussed that were non-negotiable with the State and Army Corps, such as the perpetuity of the easement, the height of the dune and the assignment of the easement.  Other issues discussed were the Surf City ordnances, the possibility of an easement license instead of a deed, the fear of commercial development (boardwalks, etc.), and rip currents.  Suzanne Keller submitted a newspaper article regarding beach replenishment and the effects it may have on rip currents.  Ken Porro gave a marked up deed to the Mayor outlining his client’s concerns.

 

One issue the Mayor said that he could address with the DEP is to attach an addendum to the easement agreement regarding commercialization of the easements, if that would help in the decision of signing the deed.
