HARVEY CEDARS, NJ January 20, 2009
The regular meeting of the Board of Commissioners of the Borough of Harvey Cedars, NJ was called to order by Mayor Oldham at 4:33pm who stated to the best of his knowledge all requirements of the State Sunshine Law had been met. Commissioners Gerkens and Garofalo and Board Attorney William Hiering, Jr. were present.
The Mayor asked all to rise for the Pledge of Allegiance.
Motion to approve the minutes of the previous meeting, January 2, 2009, was made by
Commissioner Gerkens, seconded by Commissioner Garofalo.
The Mayor read the following resolution by title only and asked for a motion to adopt.
AUTHORIZATION OF CONTRACT FOR CDL DRUG & ALCOHOL PROGRAM FOR 2009

A motion was made by Commissioner Garofalo, seconded by Commissioner Gerkens, to approve the request to use Sunset Park to Barbie Clarke for a wedding ceremony on Saturday, May 30, 2009 from 5pm to 9pm.
A motion was made by Commissioner Garofalo, seconded by Commissioner Gerkens, to grant permission to Alliance for a Living Ocean and the LBI Business Association to clean up the streets and beaches of Harvey Cedars on April 25, 2009 for the 1st Annual island-wide “Green Up Clean Up” from 9am- 12pm.
PRIVILEGE OF THE FLOOR –
Al Wright asked the Board for an update of the beach replenishment project. Mayor Oldham said the Borough has been struggling to get the appraisals approved by the Army Corps’ real estate division in Baltimore. The Mayor said there have been difficulties determining monetary damage of view; the Army Corps’ standing is that the special benefit of the beach project is worth more than the loss of view, and they are prepared to test that theory in court. The Army Corps must approve the appraisals in order for the Borough to cost share any compensation. There is also difficulty getting a value on non-buildable properties, of which there are 4. There are 5 properties that have been filed in court, 4 of which have been put on hold for further negotiations. The bid opening for the project has been postponed to March; placing sand on the beach in the summer is an option, but can be postponed until September.
