ORDINANCE NO. 2006-14

 

AN ORDINANCE AMENDING CHAPTER 7 OF THE REVISED GENERAL ORDINANCES OF THE BOROUGH OF HARVEY CEDARS, 1975, ENTITLED

“SEWER AND WATER”

 

            BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE BOROUGH OF HARVEY CEDARS as follows:

 

Section 1.         Section 7-2.1 entitled “Rates” is hereby amended by adding the following:

 

 “SCHEDULE C”

 

All new residential construction and major renovations, herein after defined, to any structure, including residential dwelling units, shall install remote-read water service connection meters, in accordance with the specifications adopted by the Borough Superintendent.  No Certificate of Occupancy for any such new construction or renovation shall be issued until a certification of the installation of the appropriate water meter is provided by the Borough Superintendent to the Borough Building Code Official.

 

The owners of the above-described properties shall be billed for metered water usage in accordance with the following schedule:

 

There shall be a minimum fee of forty dollars ($40.00) per quarter for each residential dwelling unit up to 5,000 gallons of water per quarter.  Thereafter, the following fees shall be calculated quarterly and billed annually:

 

                                5,001 – 15,000 @ $1.30/thousand gallons

                              15,001 – 20,000 @ $1.50/thousand gallons

                              20,001 – 35,000 @ $3.25/thousand gallons

                              35,001 and above @ $3.50/thousand gallons

 

Major renovation shall mean any repair, reconstruction, rehabilitation addition, or other improvement of a structure, the cost of which equals or exceeds fifty percent (50%) of the assessed value of the structure either before the improvement is started or if the structure has been damaged and is being restored before the damage occurred.  Substantial improvement is commenced when the first alteration of any structural part of the building is begun.

 

Section 2.         All of the provisions of Chapter 7 of the Revised General Ordinances of the Borough of Harvey Cedars, 1975, consistent herewith, are reaffirmed and readopted as if more fully set forth herein, and any provisions of said Ordinance which are inconsistent herewith are hereby repealed.

 

Section 3.         If any provision, section, subsection, or paragraph of this ordinance shall be declared to be unconstitutional, invalid or inoperative, in whole or in part, by a Court of competent jurisdiction, such provision, section, subsection, or paragraph shall, to the extent that it is not unconstitutional, invalid or inoperative, remain in full force and effect, and no such determination shall be deemed to invalidate the remaining provisions, subsections, or paragraphs of this ordinance.

 

Section 4.         This Ordinance shall take effect upon final adoption after publication in accordance with law.
