ORDINANCE NO. 2007-04

AN ORDINANCE AMENDING CHAPTER 4 OF THE REVISED GENERAL ORDINANCES OF THE BOROUGH OF HARVEY CEDARS, 1975, ENTITLED “GENERAL LICENSING”

THE BOARD OF COMMISSIONERS OF THE BOROUGH OF HARVEY CEDARS, OCEAN COUNTY, NEW JERSEY, DOES ORDAIN:

Section 1.        Section 4-3.2 of the Revised General Ordinances of the Borough of Harvey Cedars, 1975, Entitled “Fees for Use of Beaches” is hereby amended to read as follows:

c. Twenty-three ($23.00) dollars per person per season provided that the application is made to the proper authorities on or before June 15 of the bathing season.

d. Thirty-five ($35.00) dollars per person per season in the event that the application is made to the proper authority subsequent to June 15 of the bathing season.

e. Twenty ($20.00) dollars per person per week for any week or fractional part thereof of the bathing season.

f. Six ($6.00) dollars per person per day, or any fractional part thereof, for the bathing season. 

Section 2.        All ordinances or parts of ordinances inconsistent herewith are repealed to the extent of such inconsistency.

Section 3.        If any word, phrase, clause, section or provision of this ordinance shall be found by any court of competent jurisdiction to be unenforceable, illegal or unconstitutional, such word, phrase, clause, section or provision shall be severable from the balance of the ordinance and the remainder of the ordinance shall remain in full force and effect.
