ORDINANCE NO. 2008-08
AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 7 OF THE
REVISED GENERAL ORDINANCES OF THE BOROUGH OF
WHEREAS the Borough of Harvey Cedars has been mandated by the State of New Jersey to install water meters for each homeowner by June 1, 2008; and
WHEREAS each homeowner has been notified of the requirements to install or repair the homeowner’s meter pit, which houses the mandated water meter, at the homeowner’s expense; and
WHEREAS in order to comply with the State’s deadline of June 1, 2008, each homeowner has been given a deadline by the Borough of December 31, 2007 for said installation or repair of homeowner’s meter pit; and
WHEREAS the failure of property owners to comply with the installation or repair has compelled the Borough to enact this ordinance.
BE IT
ORDAINED BY THE BOARD OF COMMISSIONERS OF THE BOROUGH OF
Section 1. Section 7-2.7 entitled “WATER SERVICE. Installation or repairs by the Borough.” is hereby added as follows:
If the property owner fails to comply with the installation or repair of their water meter pit, it shall be the duty of the Department of Public Works to arrange for installation or repair of said meter pit, which may include the hiring of an outside contractor at prevailing wage. All costs incurred for said services and materials shall be charged to the homeowner and shall be collected and enforced by the Borough according to law.
In addition to the abovementioned costs, an administrative fee of $500.00 shall be charged to the homeowner and shall be collected and enforced according to law.
Section 2. All ordinances or parts of ordinances inconsistent herewith are repealed to the extent of such inconsistency.
Section 3. If any word, phrase, clause, section or provision of this ordinance shall be found by any court of competent jurisdiction to be unenforceable, illegal or unconstitutional, such word, phrase, clause, section or provision shall be severable from the balance of the ordinance and the remainder of the ordinance shall remain in full force and effect.
Section 4. This Ordinance shall take effect upon final adoption after publication in accordance with law.
