ORDINANCE NO. 2009-03

 

AN ORDINANCE OF THE BOROUGH OF HARVEY CEDARS

AMENDING CHAPTER 4 OF THE REVISED

GENERAL ORDINANCES OF THE BOROUGH OF HARVEY CEDARS,

1975, ENTITLED “GENERAL LICENSING”

 

            BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE BOROUGH OF HARVEY CEDARS as follows:

 

Section 1.         Section 4-5.2 of the Revised General Ordinances of the Borough of Harvey Cedars, 1975, entitled “License Required; Fee; Maximum Number; Display” is amended to read as follows:

 

b.      Such license shall be issued to any one person a maximum of two (2) times within a calendar year and no such license shall be issued for more than two consecutive calendar days.  Charitable and religious and civic organizations may be allowed more than two licenses with the approval of the Borough Board of Commissioners.

 

Section 2.         Section 4-5.4 of the Revised General Ordinances of the Borough of Harvey Cedars, 1975, entitled “Hours of Sale” is amended to read as follows:

 

All garage sales must be conducted between the hours of 7:00 a.m. and 6:00 p.m. only.

 

Section 3.         Section 4-5.5 of the Revised General Ordinances of the Borough of Harvey Cedars, 1975, entitled “Sign Regulations” is hereby repealed in full and supplemented as follows:

 

No sign for the advertisement of the sale shall be posted or erected any earlier than one week prior to sale and all signs shall be removed within 24 hours after the completion of the sale.

 

Section 4.         Section 4-8.1 of the Revised General Ordinances of the Borough of Harvey Cedars, 1975, entitled “Fees Established” is amended to read as follows:

 

                        e.  Bid specification fees            $10.00 - $100.00

 

Section 5.         If any provision, section, subsection, or paragraph of this ordinance shall be declared to be unconstitutional, invalid or inoperative, in whole or in part, by a Court of competent jurisdiction, such provision, section, subsection, or paragraph shall, to the extent that it is not unconstitutional, invalid or inoperative, remain in full force and effect, and no such determination shall be deemed to invalidate the remaining provisions, subsections, or paragraphs of this ordinance.

 

Section 6.         This Ordinance shall take effect upon final adoption after publication in accordance with law.
