RESOLUTION #2006-094

AUTHORIZING EMERGENCY APPROPRIATION PURSUANT TO

NJS 40A:4-48 FOR THE PURCHASE OF FUEL, ELECTRICITY AND

WATER SAMPLE TESTING

WHEREAS an emergency has arisen in the utility fund with respect to fuel, electricity and new water testing requirements and no adequate provision was made in the 2006 budget for the aforesaid purposes; and

WHEREAS N.J.S. A. 40A:4-46 provides for the creation of an emergency appropriation for the purpose mentioned above; and

WHEREAS the total amount of emergency appropriations created, including the appropriations to be created by this resolution, is $25,000.00 and three percent (3%) of the total operating utility appropriation in the budget for 2006 is $25,441.92; and

WHEREAS the foregoing appropriation together with prior appropriations does not exceed three percent (3%) of the total operating utility appropriations in the utility budget for 2006.

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Harvey Cedars (not less than two-thirds of all the members thereof affirmatively concurring) that in accordance with N.J.S.A. 40A:4-48 that:

1. An emergency appropriation for the utility fund be and the same is hereby made for in the amount of $5,000.00 for Gasoline & Diesel Fuel, $15,000 for Electric, and $5,000 for Water Sample Testing.
2. That said emergency appropriation shall be provided in full in the 2007 budget, pursuant to NJS 40A:4-53.3C (1).
3. That the Chief Financial Officer has certified that the expenditures to be financed through this resolution are related to the aforementioned emergency.
4. That two certified copies of this resolution be filed with the Director of Local Government Services.
