RESOLUTION #2006-081

REJECTING ALL BIDS FOR THE REPAIRS AND PAINTING OF THE WATER TOWER

WHEREAS the Borough of Harvey Cedars has solicited bids to paint and repair the water tower at Hudson Avenue and said bids were opened as advertised on August 30, 2006; and

WHEREAS Ordinance No. 2006-10 of the Borough of Harvey Cedars authorized One Hundred Thousand Dollars ($100,000.00) for the painting and repairs of the water tower; and

WHEREAS Allied Painting, Inc. submitted the lowest bid for the project in the amount of One Hundred Twenty Six Thousand Dollars ($126,000.00); and

WHEREAS pursuant to the Local Public Contracts Law, NJSA 40A:11-13.2, a contracting unit may reject all bids if the lowest bid substantially exceeds the cost estimates for the goods or services; and

WHEREAS the Governing Body has determined that the Borough does not have sufficient funds at this time to pay for said project.

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Harvey Cedars for the reasons aforesaid, that all bids are hereby rejected for the painting and repairs of the water tower.
