AMENDMENT TO THE POLICY AND PROCEDURE MANUAL FOR THE BOROUGH OF HARVEY CEDARS
WHEREAS the Borough of Harvey Cedars adopted employment policies and procedures on February 7, 1997 which are available to the employees through an encompassing manual known as the Policy and Procedure Manual; and
WHEREAS said manual shall be reviewed from time to time for policy updates.
NOW, THEREFORE, BE IT RESOLVED that the Board of Commissioners of the Borough of Harvey Cedars hereby adopts the following changes to the personnel Policy and Procedure Manual for the Borough of Harvey Cedars:
1. Section 12 Drug and Alcohol Policy is hereby amended by replacing paragraphs 2 and 3 with the following:
Possession and/or consumption of alcoholic beverages while on the job is prohibited, and engaging in such activity will subject an employee to disciplinary action up to and including termination. Employees who report to work intoxicated will be removed from the job site by their supervisor so as not to disrupt the work activity or pose a danger to other employees on the job site. Employees so removed will not be paid for any portion of the workday.
The unlawful manufacture, distribution, dispensation, possession and/or use of any illicit drugs while on the job is prohibited, and engaging in any such activity will subject an employee to disciplinary action. Employees who are found to possess such drugs or who, due to the use of such drugs are unable to perform their duties, disrupt work activity, or pose a danger to themselves or to other employees on the job site will be removed by their supervisor. Employees so removed will not be paid for any portion of the workday.
2. Section 12 Drug and Alcohol Policy is hereby amended by replacing paragraph 6 with the following:
In an effort to insure that the Borough is an "Alcohol and Drug Free Workplace" and to comply with Department of Transportation Regulations, a drug testing program will be in effect for all Commercial Drivers License holders. This program will provide for pre-employment, random, post accident testing, reasonable suspicion, return to duty, and follow-up testing. Post accident testing, reasonable suspicion, return to duty, and follow-up testing will also be in effect for all other Borough employees. The Borough will retain an agent as required by law to manage and administer the testing program.
BE IT FURTHER RESOLVED as follows:
1. Any Personnel Policies or Personnel Policy Manuals inconsistent herewith are hereby repealed.
2. This update to the Policy Manual shall take effect immediately.
3. This revision of the Policy Manual shall be known as Revision 04/07.
4. The Personnel Officer shall distribute copies of this resolution to all employees.
