RESOLUTION #2007-054

PETITIONING COMCAST CABLE TV TO IMPROVE ITS TV SIGNAL & ADJUST ITS SERVICE FEES DURING PERIODS OF POOR QUALITY SERVICE

            WHEREAS Comcast Cable TV of Long Beach Island holds a non-exclusive cable TV franchise within the Borough of Harvey Cedars; and

WHEREAS in providing services to its customers, Borough of Harvey Cedars Ordinance No. 2004-20 requires that Comcast Cable TV must comply with all applicable state and federal statutes and regulations, and it must also strive to meet or exceed all voluntary company and industry quality standards in the deliver of TV service to its customers; and

WHEREAS Borough of Harvey Cedars Ordinance No. 2004-20 further requires that Comcast Cable TV shall be prepare to report on it to the municipality upon written request of the Municipal Clerk; and

WHEREAS over the past several months, the quality of the cable TV signal being provided to the customers in the Borough of Harvey Cedars has been exceptionally poor, with distorted picture, inconsistent sound, and disrupted video; and

WHEREAS the customers within the Borough of Harvey Cedars are not receiving the quality of service they deserve, nor are they receiving a viewable cable TV signal that they are being charged for; and

WHEREAS the residents of the Borough of Harvey Cedars deserve an explanation from Comcast Cable TV, as well as a partial refund for TV service defectively provided; and

WHEREAS the Borough of Harvey Cedars Ordinance No. 2004-20 further requires Comcast Cable TV to appear at least once annually, upon written request of the Borough, at a public hearing of the governing body, to discuss matters pertaining to the provision of cable service to the residents of the Borough and other related issues as the Borough may see fit; and

WHEREAS it is the desire of the Board of Commissioners of the Borough of Harvey Cedars to petition Comcast Cable TV of Long Beach Island to improve its TV signal and adjust its service fees during periods of poor quality TV service, and to appear before the Board of Commissioners to discuss the same.

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Harvey Cedars as follows:

1. The Board of Commissioners of the Borough of Harvey Cedars does hereby petition Comcast Cable TV of Long Beach Island to improve its TV signal and adjust its service fees during periods of poor quality TV service.

2. The Board of Commissioners further request that Comcast Cable TV of Long Beach Island appear at the next public hearing of this governing body to discuss matters pertaining to the provision of cable service to the residents of the Borough.

3. A certified copy of this resolution shall be forwarded to Comcast Cable TV of Long Beach Island, the NJBPU Office of Cable Television and to all other municipalities within the service area of Comcast Cable TV of Long Beach Island.
